72 hours allowed for exchanges or refunds only on stocking area rugs from the date of purchase not inclusive of runners All carpet, ceramic, stone, wood, laminate, vinyl, area rugs, runners, trim and accessories are non-returnable & non-refundable No return on stocking carpet that has been cut and/or bound No refunds without original receipt. Refunds will be issued in original form of payment. When form of payment is check a refund check will be issued in 10 business days. When form of payment is cash, maximum cash refund is $100, anything refund above $100 will be issued a refund check within 10 business days. All Custom/Special Orders cannot be cancelled or returned. These orders are made to customers’ exact specifications and once approved by the customer are considered final. Customer understands there may be a dye-lot variation from sample.
We require a 50% deposit on ALL orders. Balance is due upon completion of installation or upon delivery of merchandise. There are NO EXCEPTIONS.
Prior to installation all cabinets, bookcases, entertainment centers, closets and all breakables must be moved away from area of installation. Disconnect all electrical equipment including computers, televisions, stereo systems and surround sound systems. Gas appliances, hookups and any plumbing must be disconnected by a licensed tradesmen before flooring installation. All drywall, plaster, paint should be completed before installation. Flooring should be the last phase of a remodel. We are not responsible for any dents, scratches or damaged flooring due to continued construction/remodeling after the flooring installation. Jobsite must have running water, electricity and temperature must be between 60 – 80 degrees Fahrenheit. All children & pets must be kept away from flooring installers & stay clear of the installation. Rooms must be clear of all obstacles or there will be a $100 per room charge.
Floor Expo Inc. under no circumstances will be responsible for the condition of any existing flooring surface, subflooring or structure or the effect of existing flooring surface, subflooring or structure on the installation of any merchandise or separation, cracking, movement, warping or any other adverse condition of merchandise where the condition of any existing flooring surface, subflooring or structure is a substantial contributing factor to the adverse condition. Subject to the above, Floor Expo Inc. warrants the installation of carpet, wood, ceramic, laminate, vinyl and stone for a period of one year from the date the installer completes the installation, to be free of material defects in workmanship. It is expressly agreed that Floor Expo Inc. makes no other warranty, whether express or implied and that the implied warranty of merchantability, the implied warranty of fitness for a particular purpose and any and all other implied warranties are excluded and disclaimed by the parties. All claims of defective workmanship will result in inspection by an independent certified inspector, chosen by Floor Expo Inc. The inspector’s opinion is final and binding on all parties. All claims concerning defective installation shall be made in writing. No claim for defective installation may be made by customer after one year from the date of substantial completion of installation. It is expressly agreed that Floor Expo Inc.’s liability regarding defective installation is limited to and customer’s sole and exclusive remedy is limited to repair or replacement through Floor Expo Inc. of merchandise and its installation by Floor Expo Inc., if determined by the independent inspector to be materially defective. Replacement shall be with the same or equivalent merchandise. In lieu of repair or replacement, Floor Expo Inc. may also agree at its sole discretion to pay customer and customer shall accept as its sole remedy, if selected by Floor Expo Inc., a sum equal to the sum paid by customer for the subject material and installation as appears on this invoice. Any and all other remedies, including, but not limited to consequential damages, incidental damages, statutory attorney fees, punitive damages, exemplary damages are excluded and disclaimed by the parties. At our discretion, we may issue a refund as long as flooring is in returnable condition. Whether the floor is returnable is at the discretion of Floor Expo.
It is expressly agreed that Floor Expo Inc. make no warranty whether expressed or implied if the customer purchases materials only (i.e. carpet only, wood only, vinyl only, laminate only, etc.) We strongly suggest that Floor Expo Inc.’s certified, licensed, insured & expert flooring installers install the flooring purchased from Floor Expo Inc. If customer declines Floor Expo Inc. installation and uses another installer, Floor Expo Inc. is not responsible or can be held liable for improper installation of flooring purchased from Floor Expo Inc. Only recourse customer may have is to file a Manufacturer claim directly through the flooring manufacturer.
Merchandise is covered exclusively by Manufacturers Warranty, if any. It is expressly agreed that Floor Expo Inc. make no warranty whether expressed or implied. Damage caused by abuse, neglect, improper care/cleaning or acts of nature is excluded and disclaimed by the parties. All claims presented to Floor Expo Inc. will be inspected by an independent certified inspector chosen by the manufacturer. The inspector’s decision is final and binding on all parties. No claims for defective merchandise may be made by customer after expiration of manufacturer’s warranty, if any. It is expressly agreed that Floor Expo Inc.’s liability regarding merchandise is limited to and customer’s sole and exclusive remedy is limited to manufacturer’s repair or replacement through Floor Expo Inc. of merchandise determined by the independent inspector to be defective. Replacement shall be with the same or equivalent merchandise.
Floor Expo Inc. is not responsible for chips, dents and/or scratches on moldings, doors, walls, steps and/or fixtures Floor Expo Inc. is not responsible for manufacturer and/or shipper delays. To reschedule an installation date, a minimum notice of 72 hours is required or a $500 fee will be assessed. There are no other agreements, understandings, representations or terms. It supersedes and replaces all previous discussions, understandings and agreements, oral or written. It may not be changed orally but only in writing signed by both parties. Collection & Legal fees, if incurred, will be added.
